Article 1 . Proprietary Rights
The cDs Social Media App and all copyright, patent, trade secret, trade mark and other proprietary or intellectual property rights of whatsoever, howsoever and wheresoever arising in the app and in all other written or oral information provided by cDs are and shall remain the exclusive property of cDs. cDs warrants that it has the right to license the app to the User on the present terms and conditions. The User shall not acquire any intellectual property rights of whatever nature in the system.
Article 2 . Purpose of app
The cDs Social Media App allows Instagram users represented by agencies using website and image sharing systems provided by cDs to share certain Instagram information with their agent.
The cDs Social Media App allows Instagram users having previously shared their information to remove said information.
Article 3 . Conditions & Liability
Using the cDs Social Media App is free of charge.
User is exclusively responsible for its use of the CDS app.
SUBJECT TO APPLICABLE LAW, CDS AND ITS AFFILIATES AND SUPPLIERS ARE NOT LIABLE FOR ANY OF THE FOLLOWING: (A) INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES; (B) DAMAGES RELATING TO FAILURES OF TELECOMMUNICATIONS, THE INTERNET, ELECTRONIC COMMUNICATIONS, CORRUPTION, SECURITY, LOSS OR THEFT OF DATA, VIRUSES, SPYWARE, LOSS OF BUSINESS, REVENUE, PROFITS OR INVESTMENT. THE ABOVE LIMITATIONS APPLY EVEN IF CDS AND ITS AFFILIATES AND SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS AGREEMENT SETS FORTH THE ENTIRE LIABILITY OF CDS, ITS AFFILIATES AND CLIENT’S EXCLUSIVE REMEDY WITH RESPECT TO THE SERVICES AND ITS USE.
Article 4 . Confidentiality

Article 5. Law and dispute
The relationship between cDs and the User shall in all respects be governed by and construed in accordance with the laws applicable in the State of New York. The User and cDs shall submit to the non-exclusive jurisdiction of the New York State courts in connection with any dispute or proceedings arising out any contract incorporating these Terms and Conditions.
